1. Use of the Service

• Lawful Use: You agree to use Artistry only for lawful, personal, and non-commercial purposes. You may not use the Service to violate any applicable local, state, national, or international law or regulation.
• Account Protection: We connect securely to Spotify and never see or store your password. To help keep your account safe, please ensure you log out when using shared devices and protect your personal device.
• Prohibited Conduct: You agree not to distribute viruses, malware, or harmful code; attempt to reverse engineer or scrape the Service; bypass any security measures; or use the Service in any way that infringes upon the intellectual property rights of others.

2. Spotify Integration and Third-Party Services

• API Usage: Artistry uses the Spotify Web API to generate playlists, analyze playlists, and explore artist journeys. We act as a conduit to your Spotify account and the Spotify catalog.
• Spotify Terms: By using Artistry, you agree to remain fully bound by Spotify's Terms of Use and Privacy Policy.
• Revocation: You may disconnect Artistry from your Spotify account at any time by utilizing the application management settings within your Spotify account dashboard.

3. Intellectual Property Rights

Our Content: The visual interfaces, graphics, design, compilation, software, and all other elements of Artistry are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

Spotify Content: All music, artwork, artist metadata, and related audio data accessed through the Service remain the sole intellectual property of Spotify and its respective licensors.

4. Disclaimer of Warranties

SERVICE PROVIDED "AS IS": Artistry is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

• We do not warrant that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free.
• We do not guarantee the accuracy or reliability of any playlist generation, analysis, or catalog data provided through the Spotify API.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTISTRY, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

You agree to defend, indemnify, and hold harmless Artistry and its developers from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

7. Modifications to the Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Any changes will become effective immediately upon being posted on this page. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
